The General Conditions of Sale referred to on this web page refer to and regulate the offer of products and the sale, order and purchase of the same made on the website www.xdecem.com, managed by Paolo Grillo, P. VAT 03862910274, registration in the Register of Companies of Venice T114095295 REA: VE-345239-With registered office located in Via Alvisopoli 9/E 30126 Venice. It is the operational headquarters in Via Sandro Gallo 157/G -30126-Venezia.
It is important to read these General Conditions of Sale carefully before proceeding with the electronic transmission of the product order form through www.xdecem.com Together with the Privacy Policy of this e-commerce activity and the Conditions of Use of the site, in fact, the Conditions govern the contractual relationship with reference to the purchase of products made through the site www.xdecem.com.
Paolo Grillo as owner of DECEM reserves the right to modify unilaterally and at his own sole discretion, in compliance with current legislation, the General Conditions of Sale defined here, with immediate effect on the offers submitted and on the transactions made after this change; you are therefore invited to check them regularly, before each purchase.
Of the changes made will be given simultaneous communication with a special banner that will be inserted with appropriate visibility on the home page of the site www.xdecem.com.

Also for the purposes of the provisions of art. 6, par. 2, of Reg. 593/2008/EC and without prejudice to the provisions of Article 5(1) and the second of Article 2 thereof – where applicable – and for the purposes and within the limits set out in Article 5(2) of the Rome Convention of 19 June 1980 (Conv. 80/934/EEC) – where the same is applicable – , purchases are regulated by current Italian legislation and in particular by Legislative Decree no. 206/2005 (Consumer Code) and Legislative Decree no. 185/99 (implementation of Dir. 97/7/EC on consumer protection in relation to distance contracts), as well as Legislative Decree No 70/2003 on certain aspects of electronic commerce and the Vienna Convention of 11 April 1980 (ratified by Law No 765/1985) on the international sale of goods. The protection of the confidentiality of personal data is guaranteed in accordance with the legislation referred to in Legislative Decree no. 196/2003 - Consolidated Law on Data Confidentiality, as well as the Dir. 95/46/EC and Dir. 2002/58/EC, as updated by Directive 2009/136/EC, on cookies.
In the case of disputes arising from these General Conditions of Sale and from the execution of the same, the competent court to settle them in civil proceedings will be that of Milan (I), without prejudice to the provisions of art. 15-17 of Reg. 44/2000/EC, where applicable, also pursuant to the Agreement between Denmark and the European Community of 19 October 2005 (OJ No. L 299/61 of 16 November 2005).

1. COMMERCIAL POLICY
1.1 The products offered for sale and the e-commerce activity carried out on and through www.xdecem.com, are intended exclusively for end users of the site who are “Consumers”, over 18 (eighteen) years old, domiciled in Italy, in Member countries of the European Union or in countries intended for export.
1.2 A 'Consumer' means any natural person who acts on www.xdecem.com for purposes that are not related to their commercial, entrepreneurial or professional activity, which may be carried out. If you are interested in the purchase of the products offered on the website www.xdecem.com or to other DECEM products and you are not “Consumers” or you are domiciled outside the European Union or you wish to request the shipment of the products themselves outside the European Union or the United States of America, you are invited to contact DECEM directly at the Www.xdecem.com website and the General Conditions of Sale presented herein cannot be considered to be extended to any purchases made by you in violation of this warning, except in your favor of the applicable legal provisions in force. In consideration of its Commercial Policy, in any case, DECEM (Paolo Grillo) reserves the right not to follow up on orders from subjects other than “Consumers”, over 18 (eighteen) years of age, domiciled in Italy, in Member countries of the European Union or in the United States of America, or in any case to orders that do not comply
1.3 These General Conditions of Sale exclusively govern the offer, forwarding and acceptance of purchase orders for products on www.xdecem.com between users of www.xdecem.com and DECEM (Paolo Grillo).
1.4 The General Conditions of Sale do not regulate the provision of services or the sale of products by parties other than DECEM (Paolo Grillo) that are present on www.xdecem.com through links, banners or other hyperlinks. You are advised, before placing orders and purchasing products and services from parties other than DECEM. to check their conditions of sale, because DECEM is not and cannot be held responsible for the provision of services by third parties other than the company itself or for the conclusion of e-commerce operations between users of www.xdecem.com and third parties.
2. FORMATION OF THE CONTRACT
2.1 To form and conclude the contract for the purchase of one or more products on www.xdecem.com, you will have to complete the order form in electronic format and send it to DECEM. electronically, upon acceptance of the proposal presented on the site, following the instructions in point 2.3.
2.2 The language available to conclude the contract with DECEM s.n.c. is Italian and in English.
2.3 The completion and transmission of the on-line order forms will be carried out in the following ways:
A) When you decide to make a purchase, you will need to click on 'Add to Cart' to add your chosen product to your cart. It will then be necessary to click on “Checkout” and complete the compilation and transmission of the shipping data of the payment method.
B) If you would like to create an account on the site www.xdecem.com, you will be able to access the Reserved Area of the site, using your personal data, your e-mail address and a password. You are required to keep your password confidential and not disclose it by sharing it with third parties. DECEM (Paolo Grillo) ensures a security procedure for the recovery of the password for subsequent purchases in case you forget the same; in order to speed up future purchase transactions, however, it is advisable that you take note of the login credentials. You will then be asked to enter your residential address; however, it is possible to indicate a different address for delivery after entering. In the case of already registered users, access to the Reserved Area is done by entering the registration data in your possession.
C) Upon entering the check out area, you will be asked to indicate an email address, the name of the recipient of the delivery, the billing and shipping address; based on the address provided, the system will automatically calculate the amount of shipping costs. D) The order form in electronic format will thus be completed and it will therefore be necessary for your confirmation that you intend to proceed with the transmission of the same electronically to DECEM (Paolo Grillo). and that you have read the following information in the order form itself:

Ii. the summary of the Terms of Sale applicable to the contract (including the geographic address of DECEM's headquarters, to which you may submit claims pursuant to Section 9 of the Terms and the Terms and information on the existing warranties and support service referred to in Sections 3 and 10);
Iii. a description of the main characteristics of the products;
Iv. the detailed information relating to the price (including any customization costs) and shipping costs (both including 22% VAT (twenty-two percent); and the methods of payment, delivery and withdrawal.
Before confirming, you are therefore advised to read these instructions carefully and to print a copy for your personal use.
E) DECEM (Paolo Grillo). accepts orders regarding the models on the site www.xdecem.com, the execution times of the ordered items may vary depending on the model chosen, generally min. 15-20-30-40 working days from the time of purchase.
F) In order for the transmission to be completed, you will also be asked to verify and confirm the correctness of the order (of which the unit cost of each product will be summarized (all including VAT at 22% (twenty-two percent), and – in the case of multiple purchases – the total cost (also including VAT at 22% (twenty-two percent). You will also be asked to ascertain and – again – confirm the accuracy of the personal data, for the payment and billing of the buyer and the address of residence of the same, as well as – if different – the name and address of the recipient of the delivery.
G) In case of errors, it will be possible to modify the order form and correct the errors identified before forwarding to DECEM. It will be your responsibility to verify the accuracy of the order before processing the transmission. Upon confirmation of the accuracy of the verified data, the transmission itself will be completed.

I) In any case, by perfecting the electronic transmission of the order form, it will be definitively confirmed by you that you have read on-line and accept these General Conditions of Sale. In addition – if you have chosen the direct payment method through PayPal and Wix payments – you will be authorized to charge, as soon as the contract is concluded, the total amount indicated on the order (including any personalization fees, all inclusive of 22% VAT (twenty-two percent). In no case may you demand that DECEM proceed with the completion of the delivery or the realization of the processing necessary for the possible customization of the products before the full payment of these amounts in the manner indicated in Section 5 of the Conditions.
J) At the same time as the transmission is completed, DECEM will automatically send you an e-mail to the registration address confirming receipt of the order form, containing:
I. the Order Identification Code;
Ii. the Right of Withdrawal Policy;
Iii. a summary of the Terms of Sale applicable to the contract (including the geographic address of DECEM's premises to which you may make claims under Section 9 of the Terms and the existing warranty and support information set forth in Sections 3 and 10);
Iv. a description of the main characteristics of the products;
V. detailed information on the price (including any customization costs) and shipping costs (both including 22% VAT (twenty-two percent); and vi. the methods of payment, delivery and withdrawal. Upon sending this e-mail, DECEM (Paolo Grillo) will be deemed to have become aware of your acceptance of the proposed conditions, expressed through the transmission of the order form, thus concluding the contract with DECEM (Paolo Grillo).
K) From this moment, – if you have chosen the method of direct payment by PayPal – you may therefore be charged for the payment authorized by you of the order and the related contribution for the shipping costs, excluding for the Italian territory (both including VAT at 22% (twenty-two percent), if you have instead chosen to pay by bank transfer, you will undertake to pay, always under In no case can you expect DECEM (Paolo Grillo) to proceed with the completion of the delivery before full payment of these amounts.
2.4 The order form received will be archived at the DECEM database (Paolo Grillo) for the period of time necessary for the fulfillment of the relative order and in any case within the terms of the law. You can access your order form by consulting the “Orders” section of the Reserved Area of the site.
2.5 As specified in point 2.3, with the electronic transmission of the order form, you will unconditionally accept and undertake to observe, in relations with DECEM (Paolo Grillo), these General Conditions of Sale. You are invited to read them carefully and print a copy for your personal use. If you do not agree with some of the terms in the Terms, please do not submit the order form for the purchase of the products at www.xdecem.com.
2.6 By submitting the order form you will also confirm that you know and accept the additional information contained in www.xdecem.com, also recalled via links, including the Conditions of Use, the Privacy Policy and the Right of Withdrawal Policy. As per the Terms, you are welcome to read them carefully and print a copy for your personal use. If you do not agree with some of the terms in them, please do not submit the order form for the purchase of the products on www.xdecem.com.
3. GUARANTEES
3.1 On www.xdecem.com are offered for sale only original products designed for and whose rights of economic exploitation are owned by DECEM (Paolo Grillo).
3.2 DECEM (Paolo Grillo) does not sell through www.xdecem.com used products, irregular or of lower quality than the standards offered on the market through its alternative sales channels.
3.3 The images and colors of the products offered for sale on www.xdecem.com may not correspond to the actual ones due to the Internet browser and the monitor used. In addition, some objects on the site may appear slightly larger or smaller than the actual size because the images have been resized to fit the screen or due to the photographic techniques used. In the case of resized images, products or parts of them can be depicted larger than actual ones in order to clearly show the details, or smaller ones in order to show the item in full. Finally, the photos of the objects are purely indicative, since they are handcrafted products: largely unique pieces made by hand and without the help of industrial equipment.
3.4 The products purchased are covered by the seller's warranty, as required by applicable law. This warranty will apply to the product that has defects of conformity that cannot be found at the time of purchase, provided that the product itself is used correctly and with due diligence, i.e. in accordance with its intended purpose. Taking into account what is specified in points 3.1, 3.2 and 3.3 above, you are therefore required to examine the products upon receipt for non-compliance and possible defects or damage.
3.5 Without prejudice to the guarantees set out in point 3.4 and the other implied guarantees provided for by law, DECEM (Paolo Grillo) does not offer any further guarantees on its products.
4. Price
4.1 The price on the site in both English and Italian is expressed in Euros.
Shipping costs for the Italian territory are free for any amount and item.

5. PAYMENTS
5.1 Which method for the payment of the price of the products and the contribution for the shipping costs of the same can you choose between PayPal or Credit Card or in the case of “Offline” or “Manual” payment by bank transfer or Postepay top-up:
A) By choosing to pay with PayPal, upon confirmation of the correctness of the order you will be directed to the appropriate payment page. The related amount will be charged to your PayPal account upon confirmation of receipt of the order form by DECEM (Paolo Grillo)
B) By choosing to pay with Wix payments, you will be asked to enter your credit card information, expiration date and cvv code. The relative amount will be debited from your account upon confirmation of receipt of the order form by DECEM (Paolo Grillo)
5.2 At no time of the different payment procedures referred to in points (a) and (b) of point 5.1 above will DECEM (Paolo Grillo) be able to know your relevant financial information: since there is no transmission of data, there will be no possibility that this data will be intercepted. No computer archive of DECEM (Paolo Grillo) will therefore be able to contain, or store, this information.
6. SHIPPING AND DELIVERY OF PRODUCTS
6.1 In the following points you will find information on the specific methods of shipping and delivery of the products purchased. You are invited to pay attention to what is contained therein, because it is an integral and substantial part of these General Terms and Conditions of Sale and, therefore, will be considered fully known and accepted by you from the time of electronic transmission of the order form.
6.2 Orders placed directly through the website www.xdecem.com can be sent to Italy and the Member States of the Union and to the Non-Ee countries. The products will be sent by means of the following express couriers Bartolini (BRT) or abroad by DHL.
The goods will be delivered to the courier approximately within 1 working day in the case of delivery via BRT on national Italian territory from the purchase, and indicatively 4/5 days. For abroad and the delivery will take place:
A) If carried out with standard shipping: within an additional 1 working day for Italy, 5 (five) indicative working days for the other Member Countries of the European Union and extra cee; for Italy the cost of shipping will be free for the rest of the European Union and Extra Cee the cost of shipping may vary depending on the chosen item and destination, it being understood that free shipping for
6.3 The delivery times referred to in point 6.2 above are indicative and are in no way binding for DECEM (Paolo Grillo); they may vary in consideration of the order placed (for example, due to the immediate availability of the product already assembled according to the specifications or for the request for special customizations) or for other reasons dependent on the courier in charge of the shipment. DECEM (Paolo Grillo), while trying to comply with the terms indicated in point 6.2 above, is in fact not able to indicate an exact delivery date by guaranteeing it.
6.4 However, in the event that the delivery is not perfected:
A) within 60 (sixty) working days from the conclusion of the contract, if you have chosen to pay by PayPal or Wix Payments; you can withdraw from the order, in the manner set out in Section 7 of the Conditions, and DECEM (Paolo Grillo) will reimburse any amount already paid pursuant to Section 8, except in the case of personalized products, as better
6.5 At the time of delivery, you will be required to verify that the package is intact and corresponds to what is described in the accompanying document. In the event that there is no correspondence between the order and delivery, you can exercise the right of withdrawal set out in Section 7 of the Conditions.
6.6 If you are not domiciled in Italy, in Member Countries of the European Union and still wish to request the shipment of products outside the European Union and the United States of America, in order to request an exact count of the price with the transfer of VAT and ancillary expenses, please contact me at the following email: info@xdecem.com
7. RIGHT OF WITHDRAWAL
7.1 If you are a “Consumer”, as defined in point 1.2 of the Conditions, you have the right, in addition to your other rights, to withdraw from the contract concluded with DECEM (Paolo Grillo) (except for personalized products, pursuant to point 7.9 of this Section), without any penalty and without specifying the reason, thus also having access to the reimbursement procedures
7.2 The right referred to in point 7.1 above shall be exercised:
A) for 'Consumers' domiciled or for deliveries however required in Belgium, Bulgaria, France, Greece, Ireland, Italy, the Netherlands, Poland, the United Kingdom, Romania, Slovakia, Spain, the United States of America and Hungary: within 14 (fourteen) working days of receipt of the products purchased on www.xdecem.com;
B) for “Consumers” domiciled or for deliveries however required in Austria, Denmark, Finland, Germany, Czech Republic and Sweden: within 14 (fourteen) calendar days from receipt of the products purchased on www.xdecem.com, if said ends is greater than that referred to in point a) above, otherwise within 14 (fourteen) working days from receipt of
C) for 'Consumers' domiciled or for deliveries however required to Cyprus and Malta and to Estonia, Latvia, Lithuania, Luxembourg, Portugal and Slovenia: within 15 (fifteen) working days from receipt of the products purchased on www.xdecem.com.
7.3 To withdraw from the contract you can communicate your intention to withdraw from the purchase contract by e-mail to the address: info@xdecem.com, in any case no later than the terms referred to in point 7.2 above, taking care to indicate the Order Identification Code shown in the e-mail confirming the transmission of the order itself. If you exercise your right by e-mail in the terms of point 7.2 above, you must also strictly send, within 48 (forty-eight) hours thereafter, also confirmation of the withdrawal, by registered letter with acknowledgment of receipt sent to the geographical address referred to in the following point 9.1, showing the Identification Code of the order in question.
7.4 In the event that you are domiciled or otherwise request delivery in Denmark, France, Ireland, the Netherlands, the Czech Republic, Sweden or Hungary, in compliance with the most favorable national regulations for you to protect the “Consumer” of these Member Countries of the European Union, the withdrawal may be made by notifying you in the terms provided for in point 7.2 above and providing – in Above and from paragraph 7.8 below, lett. c) and d).
7.5 If you are instead domiciled or in any case request delivery in Spain, in compliance with the national legislation most favorable to you to protect the "Consumer" of said Member Country of the European Union, the withdrawal may be made, not only under similar conditions of freedom of form to those provided for in point 7.4 above, but also for only conclusive facts, simply by providing - within the
7.8, letters a) and b).
7.6 The withdrawal will imply the return of the products interested in DECEM (Paolo Grillo), through the delivery of the same to the courier in charge of the shipment by you within the same period referred to in point 7.2 above.
7.7 The only costs to be borne by you will be those of shipping for the return of the purchased products; you will also be responsible for any responsibility in case of loss or damage of the products themselves while in your possession and during transport for the return: you are therefore invited to ensure that you take reasonable custody measures.
7.8 In addition to the provisions of paragraphs 7.1, 7.2, 7.3, 7.4, 7.5, 7.6 and 7.7 above regarding the terms and methods of exercise, the Right of Withdrawal shall be deemed to be exercised correctly if the following conditions are also fully met:
(A) the returned products must not have been used, worn or damaged;
B) the products themselves must be returned in their original packaging, complete with everything included in the same on delivery;
(C) the delivery, referred to in point 7.6, of these products to the courier in charge of the return must be made inside an envelope or package that clearly bears the precise indication of the name and address of the sender, as well as the Order Identification Code;
D) the products attributable to the same order must finally be returned to DECEM (Paolo Grillo) in a single shipment. DECEM (Paolo Grillo) reserves the right not to accept items of the same order returned at different times.
7.9 In any case, pursuant to art. 55, co. 2, lett. c) of Legislative Decree no. 206/2005, returns on personalized products or ordered with measures outside the standard ones indicated on the site will not be accepted.
7.10 If the Right of Withdrawal is exercised following the methods and terms indicated in this Section 7, DECEM (Paolo Grillo) will reimburse you for any sums already collected for the purchase of the products in the manner and terms provided for in point 7.11 below.
7.11 The amount due will be refunded to you in the slowest possible time. In any case, within 30 (thirty) days from the date on which DECEM (Paolo Grillo) became aware of your exercise of the Right of Withdrawal (unless proven otherwise of the actual moment, to be understood on the working day following that of sending the notice of withdrawal by e-mail), the refund procedures will be activated in accordance with the provisions of the following
7.12 If you do not comply with the methods and deadlines for the exercise of the Right of Withdrawal referred to in this Section 7, as specified in point 7.11 above, you will not be entitled to a refund of the sums already paid to DECEM (Paolo Grillo); however, if already returned, you can obtain the products returned in the state in which they were returned to DE Otherwise, DECEM (Paolo Grillo) will also be able to retain the returned products, in addition to the sums already paid for their purchase, until you take charge of the costs to obtain the shipment of the products themselves or enlist a courier of the shipment in question.
8. Reimbursement
8.1 Upon receipt of the returned products, DECEM (Paolo Grillo) will make the necessary checks relating to their compliance with the conditions and terms indicated in Section 7 above. In the event that the verifications are successful, you will be sent by e-mail, to the registration address, the relative confirmation of the acceptance of the returns. Otherwise, you will receive, again at the registration address, a reasoned refusal e-mail.
8.2 Also pursuant to point 7.11, whatever the method of payment you use, the refund will be activated by DECEM (Paolo Grillo) in the shortest possible time and in any case within 30 (thirty) days from the date on which DECEM (Paolo Grillo) itself became aware of the exercise by you of the Right of Withdrawal (unless
8.3 The actual time for the repayment or return of the sums paid by you for the purchase of the returned products will also depend on the payment methods used:
A) in case of purchase by PayPal: the time of reimbursement will depend on the company managing the service; by DECEM (Paolo Grillo) will in any case be given an order to credit back to your PayPal account within the working day following that of sending by e-mail the communication of acceptance of the returns;
B) in case of purchase by bank transfer: the repayment time will be the ordinary time of making a transfer in Italy or in Member Countries of the European Union (ie within the working day following that of

8.4 The value date of the re-credit will always be the same as the charge; consequently you will not suffer any loss in terms of bank interest.
8.5 If there is no correspondence between the recipient of the products indicated in the order form and the person who made the payment of the sums due for the purchase, the refund of the sums, in case of exercise of the Right of Withdrawal, will still be executed by DECEM (Paolo Grillo) only to those who made the payment.
9. COMPLAINTS

11.1 In case you want to request customizations of the products you are about to purchase, before proceeding with the processing of the transmission of the order form and in order to be able to verify the feasibility of the engraving or any other customization required, the following procedure must be followed:
