Terms and Conditions of Sale
 

0. General Provisions

These Terms and Conditions of Sale (“Terms”) govern the offer and sale of products through www.xdecem.com (the “Site”), operated by DECEM S.r.l. unipersonale (sole shareholder: Paolo Grillo), REA VE–458068, VAT No. IT04862380278, with registered and operational office at Via Sandro Gallo 157/G, 30126 Venice (VE), Italy.
Please read these Terms carefully, together with the Privacy Policy and the Site Terms of Use, before placing any order.

DECEM S.r.l. unipersonale may amend these Terms in compliance with applicable law; new versions apply to offers published and orders placed after their publication. In case of updates, a notice will appear on the home page.
 

1. Commercial policy and eligible customers

1.1. Online sales are addressed exclusively to consumers of legal age (natural persons purchasing for purposes unrelated to entrepreneurial, commercial, craft or professional activities).
1.2. Sales are available in Italy, the European Union, and additional export-enabled countries (including the United States of America). For countries not listed at checkout, please contact info@xdecem.com to confirm availability, taxes and shipping costs.
1.3. DECEM reserves the right to refuse orders not compliant with this policy (e.g., non-consumer buyers or minors).
 

2. Contract formation

2.1. To purchase, add the product to your cart, proceed to Checkout, enter the required data and confirm the order.
2.2. The contract language is Italian or English.
2.3. Before submission, the order summary displays: main product features, total price (including any customization), VAT and applicable shipping costs, payment and delivery methods, and withdrawal information. Please verify your data and correct any errors.
2.4. The order is submitted upon electronic transmission. Receipt is confirmed by e-mail including: order number, applicable terms summary, and contacts for claims/support.
2.5. The contract is deemed concluded when you receive the order confirmation e-mail.
2.6. Orders are processed within the production times indicated (see §6). Orders are stored in DECEM’s database for the time necessary to fulfil them and as required by law.
 

3. Products, images and warranties

3.1. The Site sells original products for which DECEM holds the economic exploitation rights.
3.2. DECEM does not sell used, irregular or sub-standard items.
3.3. Images may differ from the actual product (display color rendering, photography, resizing). As these are handcrafted goods, minor variations are possible and do not constitute a defect.
3.4. The statutory legal warranty of conformity applies pursuant to Italian Consumer Code (Legislative Decree 206/2005).
 

4. Prices, VAT, duties

4.1. Prices are listed in Euro.
4.2. EU: prices are VAT-inclusive (22%).
4.3. Non-EU: Italian VAT does not apply (Art. 8, Presidential Decree 633/1972). Import duties and taxes are borne by the recipient and vary by country.
4.4. Shipping costs and any free-shipping thresholds are shown at checkout and/or on the dedicated “Country Destination” page. Unless otherwise indicated, shipping within Italy is free.
4.5. Upon request, DECEM provides a price breakdown with separate VAT indication: info@xdecem.com.
 

5. Payments

5.1. Accepted methods: Credit Card (Wix Payments), PayPal, bank transfer (manual payment) and, where available, Postepay top-up.
5.2. For Card/PayPal payments, your account is charged upon order confirmation.
5.3. DECEM does not access customers’ financial data; such data are processed by the respective payment providers.
 

6. Production time, shipping and delivery

6.1. Production: 15–40 business days (depending on model and seasonality). Estimated times are indicated on the product page; customizations may extend them.
6.2. Courier transit (shipping):

• Italy (BRT): approx. 1–2 business days.

• EU/Non-EU (DHL): approx. 3–6 business days.
  6.3. The above terms are indicative and non-binding; delays attributable to the courier or force majeure do not entail DECEM’s liability.
  6.4. If delivery does not occur within 60 business days from contract conclusion (except for customized products), you may withdraw and receive a refund of amounts paid (§7–8).
  6.5. Upon delivery, please check the package integrity and its correspondence with the transport document; in case of anomalies, promptly notify the courier and info@xdecem.com.
   

7. Right of withdrawal (consumer)

7.1. You may withdraw within 14 calendar days from delivery (Arts. 52 et seq., Italian Consumer Code).
7.2. To exercise withdrawal, send an explicit statement by e-mail to info@xdecem.com indicating the order numberand products. DECEM will provide return instructions.
7.3. Products must be returned intact, unused/unworn, with original packaging and accessories, in a single shipmentwithin 14 days from your withdrawal notice.
7.4. Return shipping costs are borne by you; you remain responsible for loss/damage during return transit.
7.5. Exclusions (Art. 59, letter (c), Consumer Code): no withdrawal for customized or made-to-measure products (including non-standard sizes).
7.6. If withdrawal is valid, DECEM refunds all payments received for the products (excluding any additional delivery costs for non-standard shipping methods) within 14 days from receiving your withdrawal notice; the refund may be withheld until DECEM receives the goods or proof of their dispatch.
 

8. Refunds

8.1. Refunds are made using the same means of payment used for the purchase, unless otherwise agreed.
8.2. For PayPal/Card, crediting time depends on the payment provider; for bank transfer, ordinary banking times apply. The value date will not cause loss of interest.
8.3. If the purchaser differs from the payer, the refund will be made to the person who made the payment.

10. Customer support

11. Customizations

For engraving or other custom requests, contact info@xdecem.com (or call customer support) indicating your account, model and desired specs. You will receive confirmation of feasibility, technical specifications, lead times and additional costs (VAT included).
 

12. Privacy

Personal data are processed in accordance with Regulation (EU) 2016/679 (GDPR) and applicable national law (Legislative Decree 196/2003 as amended by Legislative Decree 101/2018). Please refer to the Site’s Privacy Policy and Cookie Policy.
 

13. Governing law and jurisdiction

13.1. The contract is governed by Italian law; for consumers, the mandatory protections of their habitual residence apply (Art. 6, Reg. (EC) 593/2008 – “Rome I”).
13.2. Disputes are submitted to the Consumer’s forum (place of residence or domicile of the consumer). Failing that, exclusive jurisdiction lies with the Court of Venice. Reg. (EU) 1215/2012 (jurisdiction and recognition of judgments) applies.
 

14. Amendments and updates

These Terms may be updated. The current version is published on the Site, with a notice on the home page when changes occur. We recommend printing or saving a copy.
